End User License Agreement

This agreement applies for the application “Spot a Stock” hereafter referred to as the “Application”.

Restrictions of use

You shall use the Application strictly in accordance with terms of this Agreement and shall not: (a) decompile, disassemble, reverse engineer or in any other way attempt to derive the source code of the Application; (b) violate any applicable laws, regulations or rules with Your use of the Application; (c) remove, alter or obscure any proprietary notice (including any notice of copyright or trademark) of ‘StockAppvisor ApS’ or its affiliates, partners or suppliers of the Application; (d) use the Application for any revenue generating endeavor, commercial enterprise or other purpose for which it is not designed or agreed in explicit contracts; (e) use the Application for creating a product, service or software that is, directly or indirectly, competitive with or in any way a substitute for any services, product or software offered by ‘StockAppvisor ApS’; (f) use the Application to send automated queries, alerts or reminders to any website or to send any un-solicited commercial email; or (g) use any proprietary or interfaces of ‘StockAppvisor ApS’ in the design, development, manufacturing, licensing or distribution of any applications, accessories or devices for use with the Application. The Restrictions of Use will govern any updates and upgrades provided by ‘StockAppvisor ApS’ that replace and/or supplement the Application unless such upgrade is accompanied by a separate license in which the terms of that license will govern.

Termination of License

‘StockAppvisor ApS’ has the right at any time, and from time to time, to modify or discontinue the Application and services (or any part thereof) with or without notice. You agree that ‘StockAppvisor ApS’ shall not be liable to you or any third party for any modification, suspension or discontinuation of the Application or services. ‘StockAppvisor ApS’ reserves the right to change the Application, limit usage, change price or charge for continued usage and/or discontinue any services at any point in time.

These terms will commence upon your download of the Application and/or your commencement of the services and, unless earlier terminated, will continue in perpetuity. These terms will immediately terminate upon your breach of these terms unless such breach is curable and is actually and immediately cured by you after ‘StockAppvisor ApS’ provides notice of breach to you. Upon the termination of these Terms you will discontinue the use of the Application and Services, promptly destroy the Application and any copies thereof, and, upon request by ‘StockAppvisor ApS’ certify in writing to ‘StockAppvisor ApS’ that such destruction has taken place.

Disclaimer of Liability

Under no circumstances shall ‘StockAppvisor ApS’ or its affiliates, partners, suppliers or licensors be liable for any indirect, incidental, consequential, special or exemplary damages or losses arising out of or in connection with your access or use of or inability to use the Application and any third party content and services. This applies whether or not the damages and losses were foreseeable and whether or not ‘StockAppvisor ApS’ was advised of such damages and losses.
